Once an invention patent is granted to operate and maintain it, a patent maintenance fee must be paid annually. If the maintenance fee is not paid, patent protection expires. By regularly paying maintenance fees, the patent owner's exclusive right, commercially exploiting the invention, lasts up to 20 years from the filing date. The maintenance and renewal of the patent granted by the operation for a new period of protection shall be entered in the Patent Register, which shall be maintained by the Patent Office. In order to receive statements or extracts from the Patent Register regarding the current status of industrial property rights objects, a written request must be made.

Process description

  1. Maintaining a patent in effect
    Annual fee payable for the maintenance of the patent
    The fee shall be payable for each year following the year in which the patent award notice is published. The anniversary of the date of the patent application shall be considered as the beginning of each year. The fee for the maintenance of the patent shall be deemed to have been paid if it has been paid before the end of the current year of payment for the month in which the application date falls. If the fee has not been paid within the prescribed period, but the patent owner shall pay the fee together with the fee for the following six months, the patent shall be deemed to have been maintained.
