- Submission of the request for the surrender of the trademark registration
A request (in free form) must be submitted, which includes:
- a request to consider the trademark registration void, indicating its registration number and the corresponding filing number;
- information that allows the owner of the registration to be clearly identified;
- if necessary, the desired date the registration is to be considered void.
If the Trademark Register contains information about one or more valid license agreements in relation to the trademark registration, the request must be accompanied by the written consent of the relevant licensee that the trademark owner surrenders the registration (original).
If the Trademark Register contains information about the pledging of rights to a trademark, the request must be accompanied by the written consent of the pledgee that the trademark owner surrenders the registration (original).
A power of attorney shall be attached to the request if it is submitted through a representative. The power of attorney may be drawn up in free form. The original of the power of attorney must be submitted.
If the request for the surrender of a trademark registration does not apply to all goods and services for which the trademark is registered, it shall be considered an amendment of the trademark registration and shall be handled in accordance with the provisions of Section 41, Paragraph 5 of the Trademark Law.
- Consideration of trademark registration as void and publication
If the request for surrender of the trademark registration complies with the requirements of the law, the Patent Office shall take a decision on the trademark registration to be considered void on the date specified by the owner, but not earlier than the date on which the request was received by the Patent Office.
Information on the trademark registration being void (surrender of registration) shall be entered in the Trademark Register and published in the Official Gazette of the Patent Office. The owner of the trademark registration shall be issued with an extract from the Trademark Register in paper or electronic form that the registration is considered void.
