Rights to a trade mark on the basis of registration or an application for registration shall constitute exclusive economic rights which, in terms of the legal regime, shall be comparable to movable property within the meaning of the Civil Law. The commercial pledge shall be established on the basis of a contract or court adjudication.

Process description

  1. Filing for the registration a new commercial pledge

The application for registration of a commercial pledge and the accompanying documents shall be submitted by the pledgee, the pledgor or their authorized representative to the Register of Enterprises, which maintains the commercial pledge register. In accordance with the first part of Section 14 of the Commercial Pledge Law, the application and accompanying documents shall be submitted to the keeper of the Commercial Pledge Register electronically, using the online form provided by the keeper of the Commercial Pledge Register (https://komerckila.ur.gov.lv/#/login).

When submitting an application to the Register of Enterprises, a fee must be paid to the Patent Office for the registration of a commercial pledge note in the Trade Mark Register. The fee must be paid separately for each trademark.

  1. Registration of a new commercial pledge

Upon receipt of the decision of the Register of Enterprises on the registration of a commercial pledge, the Patent Office shall record a commercial pledge note in the Trade Mark Register. Information about the recorded note shall be communicated to the trade mark owner and published in the official gazette of the Patent Office.
