(1) Submission of a request for cancellation
A person with a legitimate interest shall submit a request for cancellation, which shall include:
- the geographical indication of the registered craft and industrial product
- information about the applicant requesting cancellation; for natural persons – name, surname, for legal persons – name
- a description of the applicant's legitimate interests
- a statement of grounds for the cancellation, an explanation of the cancellation and the reasons for it
- information confirming payment for the submission of the cancellation request
- if the cancellation request is submitted through an authorized representative, the original power of attorney shall be attached to the application
(2) Examination of the cancellation request
The Patent Office shall formally examine the cancellation request and decide whether it complies with the requirements of regulatory enactments or whether it should be rejected. If the request complies with the requirements, it shall be forwarded to the European Union Intellectual Property Office, which shall examine the request for cancellation and decide on the cancellation of the registration of the geographical indication.
