(1) Submission of a renewed self-declaration
No later than three months before the last filing of the current self-declaration, the producer shall submit:
- a self-declaration in accordance with the form
- information confirming payment for the resubmission of the self-declaration and renewal of the certificate
No later than six months before the date of issue of the initial certificate, the Patent Office shall inform the producer in writing of the resubmission of the self-declaration, but if, due to certain circumstances, the reminder has not been received, the producer shall not be exempt from the obligation to submit the self-declaration in a timely manner.
(2) Examination of the renewed self-declaration and issuance of the renewed certificate
Within two months after the submission of the renewed self-declaration, the Patent Office shall verify whether the information provided in the self-declaration is complete, and shall take a decision on the conformity with the product specification and issue a renewed certificate confirming the right to use the protected geographical indication and the Union symbol.
If the Patent Office has not received a renewed self-declaration from the producer within the specified time limit, it shall take a decision prohibiting the use of the protected geographical indication and the Union symbol on the product label in the European Union until the producer has remedied the non-compliance. The decision to prohibit the use of the geographical indication protected in the European Union and the Union symbol shall be published on the Patent Office's website.
