(1) Submission of an application for amendments
If there are amendments to be made to the product documentation, the producer group shall submit:
- a free-form application for amendments to the product documentation
- information confirming payment for the amendments
- if the documentation provides for temporary changes, the reason for the temporary changes and the period during which the temporary amendments are applicable shall be indicated
- if the objection is submitted through an authorized person, the original power of attorney shall be attached to the application.
(2) Examination of an application for amendments
If the changes do not affect the single document or do not significantly affect the product specification, or if the changes to be made are of a temporary nature, the standard amendment procedure shall apply.
However, if the amendments involve changes to the single document and significant changes to the product specifications, the Union amendment procedure shall apply. When assessing an application for amendments, the Patent Office shall announce an additional objection procedure in relation to the proposed amendments to the product documentation by publishing the amendments and information on the objection procedure on the Patent Office's website for the part to which the amendments relate.
If no objections are submitted or the amendments are acceptable, the Patent Office shall approve the amendments to the product documentation and, after their approval, publish them on the Patent Office’s website and notify the approved amendments to the European Intellectual Property Office.
